All prices displayed on our Website are in United States Dollars (USD) and are subject to change without notice. Prices do not include applicable sales tax, service fees, or delivery charges, which will be calculated and displayed at checkout prior to completing your order.
We reserve the right to correct any pricing errors on our Website, even if an order has already been placed. In the event of a pricing error, we will notify you and give you the option to proceed with the corrected price or cancel your order.

6.3 Order Confirmation
After placing an order, you will receive an email confirmation. This confirmation does not constitute acceptance of your order. We reserve the right to cancel or refuse any order for any reason, including but not limited to product unavailability, errors in pricing or product description, or problems identified by our fraud detection systems.
6.4 Refunds and Cancellations
Refund and cancellation policies vary based on the type of order and circumstances. For questions about refunds, cancellations, or disputes regarding charges, please contact us at [email protected]. We will review all requests on a case-by-case basis in accordance with applicable law.
7. Food Allergen and Dietary Information
While we make reasonable efforts to provide accurate information about ingredients and potential allergens in our food products, we cannot guarantee that our menu items are free from any specific allergen due to the possibility of cross-contamination during food preparation. Customers with food allergies or dietary restrictions are strongly encouraged to contact us directly before placing an order to discuss their specific needs.
Nutritional information, calorie counts, and ingredient lists are provided for informational purposes only and may not be perfectly accurate due to recipe variations, seasonal ingredient changes, and portion variability. This information should not be relied upon as medical or dietary advice.
8. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ALL SERVICES, CONTENT, AND MATERIALS PROVIDED BY CHUYS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE UNITED STATES FEDERAL AND STATE LAW, IN NO EVENT SHALL CHUYS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES;
- DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE WEBSITE OR SERVICES;
- DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE WEBSITE;
- DAMAGES RESULTING FROM ANY FOOD PRODUCT CONSUMED OR ORDERED THROUGH OUR SERVICES, BEYOND THE DIRECT COST OF SUCH PRODUCT;
- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

THE LIMITATIONS OF THIS SECTION SHALL APPLY EVEN IF CHUYS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Nothing in these Terms shall limit or exclude our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded under applicable law, including protections available to consumers under the Federal Trade Commission Act (FTC Act) and other applicable consumer protection laws.

We reserve the right, at our expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim. You shall not settle any claim without our prior written consent.
11. Third-Party Links and Services
Our Website may contain links to third-party websites, services, or resources that are not owned or controlled by Chuys. We provide these links as a convenience and do not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that Chuys shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any such third-party websites or services. We encourage you to review the terms and privacy policies of any third-party websites you visit.
12. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.
To the extent you are a resident of California, your use of our Services may be subject to the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). Please refer to our Privacy Policy for more information about your rights under these laws.
We are committed to protecting your personal information in accordance with applicable United States federal and state privacy laws, including the protections afforded by the Federal Trade Commission Act (FTC Act) regarding unfair or deceptive acts or practices.
13. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or related to these Terms, the Website, or the Services (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States and the applicable laws of the state in which Chuys operates, without regard to its conflict of law provisions.
To the extent that any dispute is not subject to arbitration as set forth in Section 14 below, you agree to submit to the personal jurisdiction of the federal and state courts located within the United States for the resolution of any such disputes. You waive any objection to the laying of venue of any such legal proceedings in said courts.
Our Services are intended for use by persons located within the United States. We make no representation that the Website or Services are appropriate or available for use in locations outside the United States. If you choose to access our Services from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
14. Dispute Resolution and Arbitration
14.1 Informal Resolution
Before filing any formal legal claim, you agree to attempt to resolve any dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within thirty (30) days of submission, either party may proceed to formal dispute resolution as described below.
14.2 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Except for disputes that qualify for small claims court, all disputes arising out of or related to these Terms or your use of our Services shall be resolved through binding individual arbitration. The arbitration shall be conducted by a recognized arbitration organization under its applicable rules and procedures. The arbitration shall take place in the United States, and the arbitrator shall apply applicable United States federal and state law.
You agree that any arbitration shall be conducted on an individual basis and not in a class, consolidated, or representative action. YOU ARE WAIVING YOUR RIGHT TO A TRIAL BY JURY AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
14.3 Small Claims Court Exception
Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim qualifies and remains in such court.
14.4 Time Limitation on Claims
YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
15. Term and Termination
15.1 Term
These Terms shall remain in full force and effect while you use the Website or Services. These Terms may be terminated by either party at any time.
15.2 Termination by User
You may terminate your account and cease using our Services at any time by contacting us at [email protected] or by following the account deletion procedures available through the Website, if applicable.
15.3 Termination by Chuys
We reserve the right to suspend or terminate your access to the Website and Services, with or without notice and without liability to you, for any reason, including but not limited to:
- Your violation of these Terms of Service;
- Your engagement in fraudulent or illegal activity;
- Your failure to pay for orders;

- Any conduct that we deem harmful to our business, other users, or third parties.
15.4 Effect of Termination
Upon termination, your right to use the Website and Services will immediately cease. The following provisions shall survive termination: Intellectual Property Rights, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and any other provisions that by their nature should survive termination.

- Posting the updated Terms on our Website with a new "Last Updated" date;
- Sending an email notification to the email address associated with your account (if applicable); or

Your continued use of the Website or Services after any changes to these Terms become effective constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using our Website and Services immediately.
We encourage you to review these Terms periodically for any updates. The most current version of these Terms will always be available on our Website at chuys-newhot.click.
17. Severability
If any provision of these Terms of Service is found by a court of competent jurisdiction or arbitrator to be illegal, invalid, void, or unenforceable, in whole or in part, such provision shall be deemed modified to the minimum extent necessary to make it legal, valid, and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. The illegality, invalidity, or unenforceability of such provision shall not affect any other provisions of these Terms, which shall remain in full force and effect.
The failure of Chuys to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. A waiver by us of any breach of these Terms shall not be construed as a waiver of any subsequent breach of the same or any other provision.
18. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices published by us on the Website, constitute the entire agreement between you and Chuys concerning your use of the Website and Services and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether oral or written, between you and Chuys relating to the subject matter hereof.
No amendment to or modification of these Terms shall be binding unless made in writing and signed by an authorized representative of Chuys, or posted on the Website in accordance with Section 16 above.
19. Force Majeure
Chuys shall not be liable for any failure or delay in performance of its obligations under these Terms caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government actions, civil unrest, war, terrorism, labor strikes, supply chain disruptions, utility failures, internet or telecommunications outages, or any other event beyond our reasonable control.
20. Electronic Communications
By using our Website or Services, you consent to receive communications from us electronically. We may communicate with you by email or by posting notices on the Website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing, to the fullest extent permitted by applicable law.
21. Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder, in whole or in part, by operation of law or otherwise, without our prior written consent. Any attempt to assign these Terms without such consent will be null and void.
